Bill to legalize filtering/lanesplitting passed in MT

Montana the latest state to legalize lanesplitting

https://leg.mt.gov/bills/2021/billpdf/SB0009.pdf

kinda silly max speed is 20mph, doesnt make much sense to enact city traffic abatement rules in a place that basically has no cities... and certainly zero traffic

It is nice to see more states moving in the right direction!

Meanwhile, France did a big statistical test and has decided to prohibit the same.   :-(  Look for recent news reports.

Paris will come to a standstill if scooters ride single file like cars, Marseille even more so

Great News!  Lane "filtering" is one of the few perks of living in California.

That was my thought too. Montana? Really? Is North Dakota next?

I've been in the middle of nowhere on the interstate and construction or whatever causes a huge line of vehicles.  If I am on my bike, I have illegally filtered to the next exit and tell my GPS to avoid interstates while getting me to my desired destination.  This is one of the many reasons I try and avoid interstates as much as possible when on my bikes.

I was looking a a legal opinion in a magazine the other day.

Essentially a guy over here was legally filtering between stationary traffic and some inebriated woman stepped out between cars on her way to the taxi rank and was knocked flat by the biker.

The biker subsequently got a claim against his insurance for damages

He was incensed as he felt he had no liability as the drunk woman stated that she had stepped out as she was loaded into the ambulance

The legal advice was that he was probably going to get stuck with 50/50 liability as the judge would argue that whilst legally filtering he was travelling a speed that was to great to stop in time should someone step out

Even if legal, filtering does have multiple issues should something happen
