Title: Missouri helmet law
Post by: Guzzistajohn on August 28, 2020, 06:39:06 AM
Starting today, you can ride in the show me state with no skid-lid. You can ride and fully display your head and neck tattoos if you’re 26 years old or older. Great idea Govemor.

Oh no - if there's anything worse than an oil thread...

Personally, big brother needs to leave us alone to make our own personal decisions. The LEOs have more important stuff to deal with than ensuring we wear our helmets and seat belts.

Besides, how can natural selection weed out the gene pool otherwise?

Interestingly enough, the fine for riding without a helmet in Missouri was $25 (plus court costs).  $100 if ya got busted wearing a non-DOT helmet.

This latest Missouri ruling leaves 19 states with mandatory helmet laws.

 :thumb:  Freedom of choice.

I choose to wear a FF or modular helmet, but there are times when I am in a state park and want to just do a slow roll through the campground to the camp store or office and chose not to wear a helmet where I can legally do so.

I have personally witnessed many situations where the more gear someone wears the more risk they are willing to incur.

Same ratio in Tennessee, but the odds of getting pulled over without a helmet are much higher.

One day I was riding to Florida for work (no helmet state) and saw a guy riding with just a ball cap on.  He had Kentucky plates, (no helmet state) and was hoping to make it to Florida without getting pulled over, or just didn't care.  LOL!

I run a stretch of Interstate 44 - in and out of St. Louis for work - and quite often see helmet-less riders.
Maybe entering Missouri from Illinois (no helmet state).

I'll keep wearing mine because it's the easiest way to keep my little bald head from getting sunburned !
You hairy guys do what you want.

I see riders with a quality full face helmet, sleeveless T shirt, shorts and sandals ....no politics here so nothing more to say about it...

I'll keep wearing mine, but it does seem a little silly that all the surrounding states have no requirement. How a line on a map makes a difference is beyond me.

Well, NOW the LEO's have to verify you're 26 years old and have proof of medical insurance to ride helmet-less. Great use of a LEO's time!  :thumb:

CT has been helmetless since 1975. A few years back they passed legislation that a motorcycle passenger younger that eighteen years old must wear a lid.

In Washington State we used to have a no helmet policy in the late 1970's. I was riding my trusty 1966 Suzuki 150 over to the U district in Seattle and I got stopped by the police. I did not have eye protection! I was ticketed for not having my Moto Endorsement. I took the test and have the License.
I personally like to have a helmet on my head. I have a 1/2 helmet, 3/4 helmet and a full faced helmet. It depends on the weather, as to what I wear.

Larger insurance costs I hope. Otherwise its not a personal choice.

Insurance companies dictate much of these kinds of laws which go into effect.
I wear a helmet most of the time even when passing through states with “no helmet required “ policies.
I investigated two motorcycle fatalities where Bell helmets were removed from the deceased.
I just pointed out a couple factors on the subject. Personally regardless of the law I chose to wear a helmet the majority of the time I’m on a motorcycle.

I’ve seen brains on rip rap bc someone wasn’t wearing a helmet. I’ve also had severe damage to the front of my full face helmet. Damage that would have resulted in major reconstructive work if I hadn’t been wearing it. I never ride in shorts, or T-shirts, or sandals. That’s my personal choice and anyone who wants to mock me can go right ahead.

However, all the “big brother can’t tell me what to types” sure do get offended when I tell them to their face that if they want to be idiots, that’s their right! IN MY OPINION riding without a helmet is stupid. Plain and simple. But it’s your life. Just don’t get all defensive because you get called out on it. I get called out for riding fast. That’s fine. What’s not fine is if I expected everyone to be like me. You can shake your head at me, and I’ll do the same at riders without helmets. Or with a helmet and shorts and a tank top.

Most automobile crash fatalities are due to (or heavily contributed to by) head injuries, which means that more people die in automobiles due to head injuries than die on motorcycles due to head injuries.

If it were simply a matter of "You Must Be Protected For Your Own Sake" or even "You Must Be Protected For The Good Of The Society Who Must Pay For Your Injury", then automobile drivers and passengers would be required to wear helmets too.

But they're not, which leads one to a different conclusion as to why these laws are in place.

I wear a helmet everywhere all the time on a motorcycle not because I'm afraid of a head injury if I crash (if that were true, I'd wear one in the car too or else be a bit hypocritical to myself), but because of June bugs, hail, gravel, crap thrown up from cars and trucks, and all the other hazards that I'm subject to while riding a motorcycle but not while I'm ensconced in a car.

Besides, it's a 50 year-long habit.   If they lifted the law that I could go "Tackle Out" in public, and not have to wear my pants or u-trou as I walked down the street (for which I'd get arrested today), I still wouldn't go without my pants because I'd feel naked (so to speak) without them.   Same with helmets.

I might ride down the road in my neighborhood or to the corner store without a helmet, but even if we had no law here, no way in hell I am riding over 20 mph without a full face--  not for safety sake, i just hate the wind blast in my eyes.  I feel like any open face, 3/4, or pudding bowl is torture to ride in-- my eyes are far too sensitive to deal with the wind and dust.

Does the new MO law require wearing eye protection for those without a helmet?  I know that's the case in SC

I haven't seen anything about requiring eye protection but the law prohibits being stopped to check for compliance.

See...made your connection to oil there!

Wow, this is a bummer. I sure love helmet laws.

I hope Minnesota gets mandatory helmet laws one day. Nothing would make me happier.

If health insurance, seat belts and life preservers can be mandatory then so can motorcycle helmets. Why should we get choice when no one else does? How fair is that? It isn't.

I love helmet laws.

Helmet laws, mandatory wearing of or not, I wear a helmet. My dad got me riding when I was ten and the first thing he taught me was to wear a helmet. It has been imbedded in my brain. I am not comfortable riding without a helmet. A helmet has protected my skull more than a few times. I wore helmets when I was flying. Protected my head from hard impacts at least once-that I can remember.

All that being said I am not in favor of helmet laws or almost any other laws. For you people that like to poke holes and argue I said "almost".  I respect your right to your own opinion.

I honestly don't care if someone doesn't want to wear a helmet, the problem I have with these laws is the mandatory minimum insurance requirements are pretty low. If you die, there is a burden on your family, but if you are seriously hurt and you exhaust your meager insurance with possible burden on the state, then I have a problem with those laws.

The laws should be written to exempt society from that financial burden.

Maybe the way you tell them, you think?

In my over 300,000 miles of riding I have never needed my helmet thankfully.  But like insurance, I will be happy I have it when I do something stupid and go down.

I'll chime in here with personal opinion worth about $.02...

I plan to keep wearing mine regardless of the law. I also plan to never chastise others for their choices. Their choices affect me nil whatsoever and I wish more people would worry more about themselves and not others because it's nobody's business whatsoever how others choose to live their lives in our "free" country.

I'll also say that I feel mandates shouldn't stop at helmets. I HATE seat-belts and HATE the law that I HAVE to wear one. This is America and we should be able to choose how we care for ourselves, or not and it shouldn't be the government or anyone else deciding what we do or don't do to ourselves.

Saw many LEOs and even pulled up at a traffic light next to a CHP in Barstow, and he ignored me.

Made it home in one piece...

:-)

this happened to us.. had our riding gear, helmets, and shoes stolen off the bike while we were swimming in a river just 50 yards away up by the BRP

we had no choice but ride down the mountain back to cell service sans helmet & wearing Chacos

a STUNNING number of people yelled to us "you need a helmet in NC!", flashed their lights, tried to wave us down to tell us we were driving illegally???  So many people did this, that had I planned to ride us home... but we ended up pulling over once we got to cell service and eat lunch while we waited on a free tow from AAA to get us home with no further incident

Okay, let me rephrase.

It's not the FACT that a law has been repealed. It is the controversy that will be created on this board!

DOES THAT CLEAR IT UP?

ZZ -

Nothing to clear up.   The actual List Owner has provided input to this thread as to the law, the mandates, and what American freedom is all about.

Nobody is breaking any rules, and doesn't look like they're going to - the boundaries have been set.

For me it's boots, gloves and helmet. I might forgo a jacket now and then, maybe once in the last twenty years. Some here might remember a fella named Sandy Morrison, highly skilled heavy equipment operator and Guzzi guy, fell helmetless  off a Triumph at less than 20MPH. Pretty much scrambled his noggin, never the same again. I have done the same no helmet thing on a very short test ride a Sandy did, even after Sandy had his accident but I think about it every time. I was taught that a rider frequently lands hands first followed by head followed by feet unless hit by something. I am fine with helmet laws and seatbelt laws and life jacket laws as they are meant to protect society from paying for our mistakes and privileges.

New Zealand has had a helmet law since it's inception about 45 years ago.

When it was introduced, I got a copy of the law describing the details.  It described how the helmet had to be securely fastened amongst other demands.  But it didn't say that it had to be fastened to the rider's head.

Being the rebel I was, I fastened mine to my left elbow, as I thought it needed more protection than my head.  Strangely, I never got pulled up, and soon came to my senses and started behaving.

I seem to recall that the first flip face helmets were illegal.  Not sure of their current status, but there's quite a few now using them (including me).

Somebody made a comment that reminded me of my trip out to glacier national Park. I bought a shorty half helmet to wear while “sight-seeing”. I did not realize that Montana/Canada had so many dang bugs in July!!! I had bug guts all over my glasses and face. After that excursion I wore my full face the rest of the trip. I’m a sissy like that I guess! 😂 (it should be noted I ride without a windshield)

The major problems with the helmet law is this. There is no standard in place, at least in NC, to justify A common sense helmet law, in other words there is No standard mandated!
The only compliance mandate it that it had to, a one time been DOT approved. I’ve got a 30 year old DOT approved helmet that the lining is gone and the foam is almost completely compressed. Now if anyone thinks this is an appropriate headgear for motorcycle riding, raise your hand and yet it’s perfectly legal.
It is printed on the paperwork that comes with a Bell Racing grade helmet “ IF DROPPED REPLACE”
Helmet laws as well as any other law that mandates and demands a people must comply must be based on scientific research, common sense and factual data. The fact is that in my state this is not the case with our standing helmet law. Therefore the enforcement of said law is an injustice to the people who must comply.
That being said, I’d wear one either way the majority of the time.

Lannis, I think probably the auto driving population not being required to have helmets just means they have more lawyers. If it was about saving the insurance companies money helmets would be required in autos also.

But I am under the impression that insurance expenses drove the helmet laws for motorcyclists, I could be mistaken.

I remember returning to CA after a few years in other states, and when asked about changes since I'd been away, a motor officer told me we'd never have a helmet law in CA because " The Hell's Angels have too many lawyers ". Obviously, he was incorrect.

I'll always ride helmeted.

So, 15W-50 is out of the question ?

If it can't run on Castol GTX 20w-50, it's too modern for me

Well, I'm willing to believe that it was the influence of the insurance lobby that drove helmet laws for bikes.

But now we've got to figure out what's UN-driving them.   When I were a lad, CA was the ONLY state with no helmet law.   Now MOST states have some level of helmetless riding (by age, etc).

The insurance lobby hasn't gotten any weaker, and medical expenses for head injuries haven't gone down.   So how'd that happen?

It's something nefarious, I'm sure.   Law or no law, I'm wearing mine too.

Shit I missed out on the ice cream

Luap,

On the seat belts. I have a '62 F100 with no belts. I plan to never put them in. In Ca,. if it was not standard equipment, you do not have to have them. I'm perfectly comfortable not having them. I have had passengers ask why there is no belts. Even dated a girl that wanted one. But if I put one in for the passenger, then I would also have to have one.

But, my '14 F150 has them and there is the law to wear them. I hate the law, but since they are there I feel I should wear them since I could get a fine without them.

Way, way back before the law, my Datsun 510 WAGON had seat and shoulder belts. I wore them. Why.. because the car felt sporty and I drove it that way. Ever keep up with a 350ci Malibu being sporty with a Datsun WAGON with a 1600cc????

Nothing is in driving the insurance companies. If you didn't notice, to ride sans helmet you must have health insurance.

Isn't going to affect my behavior. I'll keep doing what I've been doing. Never had a helmet stolen, but glad I can now legally ride home if it ever happens.

I understand why people ride without helmets. I also understand why I ride with one

Repealing the helmet laws moves the responsibility and liability from the state to the individual.  It's a cya move by the state.

So, aluminum, or copper crush washers?

I need some for the bikes.  What is the choice here?  Aluminum, Copper, or Orange?

I don't know if nefarious would be the appropriate description, but I do know how big business and government work, cash is always king.

I would surmise that actuarians have probably studied accident, death and long term care statistics and the increased probability of death for helmetless riders.

There could likely be substantial savings, when you consider the costs for possible long term care, rehabilitation, medical procedures, income supplement/replacement etc,,,

     or a funeral.

So if you have an 1962 motorcycle, no need to wear a helmet.  I think I understand the logic here.

I was living in Kansas in 1976 (or was it 1977 ?) when they repealed the helmet law.  If I remember correctly it was a Thursday, and on the way home from work I saw more motorcycles out on the streets than I ever had before.  Not a helmet in sight!  Even "old" guys on old BMWs were out with their ballcaps turned backwards.
Girlfriend and I rode all day on Saturday w/o helmets, and sunburned faces and heads like never before.

I have a modular which I use in very cold riding temps. However anything much over 50 degrees and it’s hot to come off and there’s no way a could stand it in hot or even warm weather. However I do always wear a helmet of done type.
