I've had a number of top-tank mopeds.  Easy and fun.  Was even considering participating in the moped races in NY.
Just didn't have any other moped friends that wanted to go.

A bit provincial, that advert, despite the fact that it's a cosmopolitan New Yorker selling it.

I don't know about the law in New York, but in most states (including Virginia), that 70cc, 45 MPH bike is the same as a Hayabusa as far as licensing, motorcycle permit, and insurance goes ...

You are correct, sir, but after a bit of searching I can't find that model anywhere shown with a 70cc engine - only a 50cc. It's possible that the 'official' records for that bike don't reflect its current state... not that we;ve ever seen that with two-wheeled machines!

It's an old and accepted ploy to put an oversize cylinder on a 50cc engine (as long as the cases/engine number aren't changed) and race around on a moped license.

Typically 35 mph is the limit for those.   They're not going to test that at licensing time, but if the bronze clock you weaving through traffic at 55, all your hard work MIGHT be lost in the impound ... !   50cc bikes LAP the Isle of Man at over 80 MPH average ....

Some go a lot faster than that.  Here's a favorite video that shows a 50cc bike at Bonneville.
