I would say Mulie due to the ear size. Other clue would be that they tend to herd up much more than whitetails. Rarely see more than half a dozen whitetail in a group but in NW KS have seen Muiie herds of 20-30 at one time.

Whitetail. The antlers provide me with the best clue. Whitetail antlers form from a main beam typically with single tines. Mule deer typically have forked tines. Where was this photo taken?

ya know, looking closer at the running away shot, you can see the rack better. I'm sayin whitetail too

this is the best buck shot I've gotten. But I see up to 8 or 9 regularly out back

Along the Minnesota river,  we don't generally have Miley's here but I don't see much of a tail, the antlers wider and straighter up than I usually see too.  Pretty nice rack developing tho right?

Hard to say but I think whitetail as well. That should be a nice deer for someone.

As far as herds, it depends upon conditions.  About 10-15 yrs ago at Valley Forge national park in PA, there were ridiculous herds of whitetail deer until they were finally thinned before they ate everything within reach into a desert.  Groups of 75-100 in different fields at the same time with lots of smaller groups in between.  It looked like they were farming deer.  My father-in-law said "you'll like seeing this- lets go for a ride..."  There were some really big racks in there.  Very fun to see. Seeing groups of 10-15 nearby in the suburbs whether the inlaws live is still pretty normal.

It's also not uncommon to see larger groups of whitetails in VT in the winter together "shed up" in a common area of shelter.  There was one very good deer shed in some hemlock near the main road between the stone studio and home, common to see at least 20 deer at a time there at the right time of day.

That is one hell of a whitetail! Moreover, he appears to be at most 3 1/2 years old. I'd sure like to visit your back yard next year he will be a beauty.
